The mediator creates, through his/her communication and leadership skills, his/her practical experience and high social competence, the trustful framework that enables the parties to solve the conflict amicably.
Costly and time consuming litigation or arbitration can thus be avoided.Mediation classically consists of five phases:
I. Creating the trustful framework
II. Presentation of the conflict by the mediands
III. Elaboration of the interest behind the conflict by the mediator
IV. Developing proposals for conflict resolution
V. Agreement on actions to resolve the conflict
Mediation's advantage consists of the sustainable enduring resolution of the conflict by taking into account the interests of all parties to the contract.
